Balancing Business and the Environment – Saving Both
The Environmental Law Clinic organised the discussion with support from the U.S. Speaker Programme and the United States Embassy in Belgrade.
In November 2023, the discussion brought together representatives of the US and Serbian judiciaries, legal practice and academia: D. Oesterle, J.D., Assistant United States Attorney; David Reese Jennings, Resident Legal Advisor and Embedded Prosecutor; Prof. Dr Mirjana Drenovak-Ivanović, Professor of Environmental Law; Danijela Sinđelić, Public Prosecutor; and Nina Nicović, Attorney-at-Law.
The discussion focused on legal instruments for enforcing environmental law and ensuring compliance with environmental regulations. By comparing US and Serbian experiences, the participants considered which mechanisms could most effectively stop violations, ensure the remediation of resulting damage and establish accountability.
For the Environmental Law Clinic students, the event provided an opportunity to examine the relationship between preventive administrative measures, civil claims and criminal prosecution, as well as the role of each mechanism in environmental protection. The activity thus contributed to strengthening the practical component of the programme.
